Mexico Publishes Click-to-Cancel Rules for Subscriptions, Requiring Five-Day Notices and Instant Cancellation

The reform to Article 76 Bis compels platforms and membership services to secure express consent and clearly disclose recurring charges before any billing.

Overview

  • The Diario Oficial de la Federación on December 12 published additions to Article 76 Bis that regulate automatic charges and cancellations for subscriptions and memberships.
  • Providers must notify consumers of automatic renewals at least five calendar days in advance and allow immediate, penalty-free cancellation.
  • Companies are required to display, in a visible way, the periodicity, amount, charge date, and renewal conditions and to obtain express, informed consent for recurring billing.
  • The reform prohibits confusing sales or advertising practices and mandates special care for communications to children, older adults, and people who are ill.
  • Authorities indicated the changes take effect Saturday, December 13, and Profeco invited consumers to report noncompliance through its official complaint channels.
