Mexico Has Two Mandatory Paid Rest Days Left in 2026

Official guidance sets pay at the daily wage plus double for work on those days, with unpaid claims handled by PROFEDET.

Overview

  • After the Independence Day observances, only two Article 74 rest days remain for 2026: Monday 16 November for the Revolution commemoration and Friday 25 December for Christmas.
  • The Revolution anniversary is legally moved to the third Monday of November so the 20 November commemoration is observed on Monday 16 November this year.
  • PROFEDET and the Labor Law require employers to pay anyone who works on a mandatory rest day their normal daily wage plus a double payment for the service, which amounts to a triple payment for that day.
  • Common cultural dates such as Día de Muertos, 12 December, Nochebuena and 31 December are not automatic mandatory rest days under Article 74 and only become time off if an employer grants them by contract or internal policy.
  • Workers who do not receive the correct holiday compensation have up to one year to file a claim with PROFEDET to recover unpaid amounts.
