Mexico Enacts 'Click-to-Cancel' Rules for Subscriptions, Effective Dec. 13

New obligations give consumers clear renewal notice plus immediate, penalty-free cancellation.

Overview

  • Mexico published the reform in the Diario Oficial de la Federación on Dec. 12, with legal effect starting Dec. 13.
  • Providers must present prominent, accessible details about recurring charges, including periodicity, amount and billing date, and obtain express informed consent.
  • When a contract includes automatic renewal, consumers must be notified at least five calendar days in advance with the option to cancel without penalty.
  • Companies are required to offer an immediate, easy-to-use cancellation mechanism that avoids hidden links, unnecessary steps or delays.
  • The rules cover streaming platforms as well as pay TV, fixed and mobile phone services and internet providers, and Profeco outlined complaint channels for noncompliance.
