Met Police Panel Drops Misconduct Case Against Firearms Officer W80 in 2015 Jermaine Baker Shooting

The panel accepted a no-case submission and will publish its reasons within five working days.

Overview

  • Independent chairman Chris McKay announced there was no case for W80 to answer and dismissed the proceedings.
  • The decision followed a no-case application by W80’s counsel, Duncan Penny KC, in a hearing described as complex with more than 3,000 pages of evidence.
  • Baker was shot at close range during a police operation to foil a prisoner snatch near Wood Green Crown Court on 11 December 2015, and a replica firearm was later found in the Audi’s rear.
  • Earlier stages included prosecutors deeming charges unwarranted in 2017, a 2022 public inquiry finding of lawful killing, and a 2023 Supreme Court ruling that allowed the IOPC-directed misconduct case to proceed.
  • W80, a counter-terrorism specialist firearms officer trained since 1998, had faced allegations of excessive force that the panel has now discontinued.
