Mendoza Publishes Decree Enforcing New Public-Tree Law

Mandatory digital registration with certification tied to forest-fund access aims to make tree management accountable to curb fatal collapses.

Overview

  • The provincial Executive issued Decreto 1.720 on Monday, August 24, 2026, to put into operation the 2026 changes to the public-tree law and to repeal the 2009 regulation.
  • The decree gives municipalities exclusive police power over trees in streets, plazas and other municipal spaces while the province keeps oversight for routes, irrigation channels and provincial or national assets.
  • All municipalities must register trees in the new 'Mi Árbol' platform and complete initial censuses within 90 days of creating an account, and they must submit four-year Integral Management Plans to obtain an annual Certificate of Management.
  • Authorities must remove or prune trees that pose an imminent risk immediately and deliver a technical report signed by a registered professional within five working days after the intervention.
  • The rule requires at least three new trees planted for each removed specimen, sets seasonal and technical pruning standards, and establishes graded fines from 100 to 15,000 Unidades Fiscales that can bar noncompliant municipalities from Fondo Forestal funds while exposing gaps in local capacity and the need for coordination with Vialidad Nacional.
