Maurene Comey Sues DOJ Over Abrupt ‘Article II’ Firing

The case challenges the administration’s use of Article II to remove a career SDNY prosecutor without cause.

Overview

  • Comey filed suit in Manhattan federal court on Sept. 15 seeking reinstatement, back pay and a declaration that her July 16 termination was unlawful.
  • Her complaint says she was notified by email that she was removed “pursuant to Article II,” and quotes interim U.S. Attorney Jay Clayton as saying, “All I can say is it came from Washington.”
  • The filing alleges she was targeted because she is James Comey’s daughter or due to perceived political beliefs, and cites a public pressure campaign by activist Laura Loomer as a factor.
  • She asserts violations of the Civil Service Reform Act and constitutional protections under the First and Fifth Amendments and Separation of Powers, naming the Justice Department, the Executive Office of the President, Attorney General Pam Bondi and OPM as defendants.
  • The suit notes she had an “Outstanding” performance review and was asked to lead a major public corruption case the day before her firing, and it comes as other unexplained prosecutor dismissals draw scrutiny; DOJ has not commented.
