Massachusetts Residents Challenge Trump's Eligibility for Ballot

Legal action cites Trump's role in Capitol insurrection as disqualifying factor under 14th Amendment

  • Massachusetts residents, backed by advocacy group Free Speech For People and civil rights firm Lichten & Liss-Riordan, P.C, have filed a challenge to bar Donald Trump from appearing on the state’s primary and general election ballot.
  • The challenge is based on the Insurrectionist Disqualification Clause (Section 3 of the Fourteenth Amendment), asserting that Trump’s role in the January 6th Capitol insurrection renders him constitutionally ineligible for public office.
  • Similar legal challenges have been initiated in states such as Minnesota, Michigan, Oregon, and Illinois. The Colorado Supreme Court and the Maine Secretary of State have ruled that Trump is disqualified from appearing on their state ballots under the same section of the Fourteenth Amendment.
  • Trump has appealed to the U.S. Supreme Court to overturn the Colorado ruling and has sued to reclaim his spot on Maine’s primary ballot.
  • Trump is also scheduled to appear in federal court in Washington on Jan. 9, when his lawyers will argue that he is immune from prosecution on charges that he illegally tried to overturn the 2020 election.
