Manipur High Court Orders New Certificates for Trans Doctor and Mandates Statewide Compliance

Sections 6 and 7 of the Transgender Act are to be treated as part of existing rules to end certificate refusals.

Overview

  • BOSEM, COHSEM, Manipur University and the Manipur Medical Council must reissue Dr Beoncy Laishram’s educational and registration certificates with her affirmed name and female gender within one month.
  • The Chief Secretary has been directed to instruct all establishments in Manipur to implement the Transgender Persons (Protection of Rights) Act, 2019 without delay.
  • The court held that provisions of Sections 6 and 7 of the Act are deemed incorporated into all current laws, rules and bye-laws in the state until formal amendments are made.
  • Judges rejected arguments that corrections must begin from the matriculation level, clarifying that each institution is independently obligated to update records upon application.
  • Laishram had already updated Aadhaar, PAN and voter ID, but refusals by boards and the medical council hindered opportunities including appearing for NEET-PG, a pattern activists say this ruling will help address.
