  • DA Alvin Bragg unsealed an 11-count state indictment Wednesday against 21-year-old Miguel Francisco Mora Nunez and 22-year-old Christhian Aybar-Berroa for the July 19 incident.
  • Charges include first- and second-degree attempted murder, assault, attempted robbery, robbery and weapons possession, supplementing earlier federal counts.
  • Prosecutors say the defendants plotted a violent robbery spree via WhatsApp that began with a phone snatching before they confronted the off-duty officer near the Little Red Lighthouse.
  • The off-duty CBP officer was shot in the face and forearm but returned fire, wounding Mora, who was arrested after being driven to a Bronx hospital, while Aybar was detained the next day.
  • The suspects, both undocumented with prior arrests, are due for arraignment in Manhattan Supreme Court the week of August 18.
