Mangione’s Lawyers Say DA Violated HIPAA With Fraudulent Subpoena

Prosecutors obtained more than 120 pages of his medical records without notifying his attorneys or the court, prompting the defense to seek sanctions, file a motion for an evidentiary hearing

Attorney Karen Friedman Agnifilo (L) and Luigi Mangione attend a hearing at Manhattan Criminal Court on February 21, 2025 in New York City. Mangione is accused of slaying of UnitedHealthcare CEO Brian Thompson late last year and is making his first appearance on state charges of murder as an act of terrorism. He is facing 11 counts for the Dec. 4 shooting of Thompson outside a midtown Manhattan hotel which set off a massive manhunt. He is also facing federal charges of murder and other charges in Pennsylvania, where he was arrested.

Overview

  • Defense attorneys allege Assistant DA Joel Seidemann misled Aetna into producing Mangione’s full medical file after requesting only his account number and coverage period
  • The subpoena cited a fictitious May 23 court date and was signed by prosecutors rather than a judge, bypassing judicial oversight and breaching doctor-patient privilege
  • Manhattan DA’s office maintains it requested minimal information, deleted the excess records upon learning of the error and informed both defense counsel and the court
  • The defense motion asks for sanctions against prosecutors, a full evidentiary hearing with sworn testimony and access to all communications between Aetna and the DA’s office
  • Mangione remains charged with state terrorism-related murder counts and federal murder and stalking charges with the death penalty sought, next appearing in state court on Sept. 16, 2025
