Malaysia to Appeal High Court Ruling on State Role in Abductions of Pastor and Activist

The attorney general says the government will challenge the judgment.

Overview

  • The Kuala Lumpur High Court found that serving or former police officers were involved in the enforced disappearances of Pastor Raymond Koh and activist Amri Che Mat, acting on an "order."
  • Police were directed to reopen both investigations and, in Koh’s case, to provide regular progress reports to the attorney general.
  • Koh’s family was awarded RM10,000 per day from Feb. 13, 2017, plus additional damages and costs, with the court ordering the funds to be held in trust until his whereabouts are known.
  • The court also awarded RM3 million to Amri’s wife, consolidating earlier findings by the national human rights commission that implicated Special Branch officers.
  • Rights groups hailed the decisions as a legal precedent for enforced disappearance cases, while the Attorney-General's Chambers confirmed it will file an appeal.
