Maharashtra Panel Backs Dropping 77 Agitation Cases as Bombay High Court Clears Two Case Withdrawals

The review applies a 2022 policy allowing protest-related prosecutions to be dropped when no death or major damage occurred, subject to leave of court.

Overview

  • Out of 201 applications, 77 were recommended for withdrawal and 47 involving serious offences were rejected, according to minister Ashish Shelar.
  • The recommended cases now go to regional committees chaired by Deputy Commissioners of Police for further scrutiny before any court motion.
  • The Bombay High Court orally permitted withdrawal of two Nagpur protest cases involving senior politicians, with a detailed order to follow and formal withdrawal to be moved in trial courts.
  • The state policy covers cases registered up to 2022, including demonetisation and Covid-era protests, only where there was no loss of life or property damage above Rs 5 lakh.
  • Applications tied to crimes against women, serious criminal offences, or personal and civil disputes are excluded, and six matters involving MLAs or MPs will be decided by the High Court under Supreme Court monitoring.
