Overview

  • Justice Freedman ruled that India’s applications for sovereign immunity and expert evidence must be addressed together, dismissing both and awarding legal costs to Choksi.
  • Choksi alleges he was abducted from his Antigua residence in May 2021, beaten and taken by yacht to Dominica by operatives he says acted on India’s orders.
  • The Indian government denies any involvement in the alleged kidnapping and contends there is no evidence linking New Delhi to the plot or English court jurisdiction.
  • Choksi was arrested in Belgium in April 2025 on an Indian extradition request and remains in custody as he continues to challenge his return to India.
  • Antigua police identified five UK-based suspects in the abduction, including a diplomat and a luxury goods expert, whom Choksi has also sued.
