Legal Battles Over Trump's Eligibility for 2024 Election Continue
Both sides appeal Colorado ruling that found Trump engaged in insurrection but can still run for office.
- Multiple lawsuits have been filed in 28 states arguing that former President Donald Trump should be barred from running for office again under the 14th Amendment's disqualification clause, which prohibits anyone who has engaged in insurrection or rebellion from holding office.
- Colorado District Court Judge Sarah B. Wallace ruled that Trump engaged in an insurrection on January 6, 2021, but concluded that the 14th Amendment does not apply to the presidency, allowing Trump to remain on the ballot.
- Both the Citizens for Responsibility and Ethics in Washington (CREW), who filed the lawsuit in Colorado, and Trump's legal team have appealed the ruling to the Colorado Supreme Court.
- Similar challenges to Trump's eligibility to run for office in Michigan and Minnesota have been dismissed.
- Trump has also been indicted in special counsel Jack Smith's investigation into the Jan. 6, 2021, Capitol riot and alleged interference in the 2020 election, but has not been charged with inciting an insurrection.
