Lammy Approves £241,500 Settlement After High Court Found Isolation Breached Rights

The payment follows a High Court finding that the prisoner’s prolonged segregation breached Article 8 rights.

Overview

  • David Lammy authorised £7,500 in compensation and about £234,000 in legal costs for Fuad Awale, confirming the figures in a 29 December letter to Robert Jenrick.
  • Mrs Justice Ellenbogen ruled in September 2024 that Awale’s segregation unlawfully interfered with his private life under Article 8 of the European Convention on Human Rights.
  • Court evidence showed Awale had not associated with other inmates since 17 March 2023 and at times spent only an hour a day outside his cell in a close supervision unit.
  • The government is weighing an appeal and potential policy or legislative changes after assessing a review by terror watchdog Jonathan Hall KC on separation regimes.
  • The Ministry of Justice said separation centres remain essential and reiterated commitment to the ECHR, while Jenrick condemned the payment and urged emergency limits on ECHR protections for extremist prisoners.
