- The opposition contends the alleged new evidence, including a 1988 letter by Erik Menendez and a statement from former Menudo member Roy Rosselló, fails to meet standards of being new, material, credible or timely.
- In May, Judge Michael Jesic resentenced Erik and Lyle Menendez to 50 years to life, making them eligible for parole after more than three decades behind bars.
- Erik and Lyle Menendez are scheduled to appear before the California Board of Parole Hearings on August 21 and 22 to determine whether they should receive a parole recommendation.
- Any positive recommendation from the parole board will be forwarded to Governor Gavin Newsom, who has 90 days to review the case and decide whether to grant or reject parole.
