The lawsuit claims that the university failed to properly investigate Paul Flores, a fellow student who was convicted of Smart's murder in 2022, despite multiple reports of him harassing other students.
The family also alleges that the university did not conduct a timely and proper investigation into Smart's disappearance, including not sealing Flores' dorm room and allowing it to be cleaned before it was searched 16 days after Smart disappeared.
Smart's family only realized the university's alleged negligence after a public apology from the university president in May 2023, as they did not have access to the university's investigative file.
The family is seeking monetary compensation from the university.
