Koldo García Files CGPJ Complaint, Accuses Supreme Court of 'Lawfare' in Mascarillas Case

The move seeks a disciplinary review after a report said the court would admit only prosecution witnesses.

Overview

  • García’s defense asked the CGPJ’s Disciplinary Commission to open a gubernative proceeding and to clarify whether any decision has been taken on excluding defense evidence, arguing a breach of deliberation secrecy or potential judicial contamination if the report proves true.
  • The complaint cites an OkDiario story claiming Supreme Court sources said the panel would accept only prosecutors’ witnesses and reject those proposed by the defenses, a media report that has not been confirmed by the court.
  • In its filing, García’s team requests the testimony of about 75 witnesses, including Fernando Grande-Marlaska, Francina Armengol, Salvador Illa and Ángel Víctor Torres.
  • The defense seeks disclosure of the cooperation terms between Víctor de Aldama and Anticorruption Prosecutors, cloned copies of recordings allegedly made at García’s home with full chain-of-custody safeguards, and a UDEF patrimonial report on Aldama to test his claimed cash capacity.
  • Scheduling is in flux after José Luis Ábalos’s new lawyer reported he is tied up for most of March, and a custody review hearing set for Thursday will determine whether Ábalos and García remain in prison pending trial.
