Kevin Jackson Files Federal Civil-Rights Suit Alleging Coercion in Overturned 2001 Murder Case

An internal conflict in the Conviction Integrity Unit prompted an outside review that condemned the investigation.

Overview

  • Jackson filed the lawsuit in federal court naming Chicago detectives Brian Forberg and John Foster, the City of Chicago, Cook County and multiple prosecutors as defendants.
  • The complaint alleges coerced witness statements, fabricated accounts and polygraph results, suppressed exculpatory evidence, and disregard of an alternative suspect.
  • An Illinois appellate panel reversed his conviction last year after roughly 23 years in prison, with Judge Mary Mikva calling the case extraordinary and the evidence thin.
  • Special prosecutors Thomas Geraghty and Robert Owen were appointed after a conflict-of-interest concern in the CIU, and their report found the investigation was tainted by coercive tactics.
  • City and county officials said they have not yet been served and do not comment on pending litigation, while Jackson also seeks a Certificate of Innocence with a hearing scheduled Monday.
