Kerala High Court Declines To Halt Voter Roll Revision, Directs State To Approach Supreme Court

Judicial comity guided the decision to step aside for the Supreme Court.

Overview

  • Justice V. G. Arun closed the State’s writ petition seeking to defer the Special Intensive Revision and left Kerala free to move the Supreme Court.
  • Kerala asked to push the revision to December 21, citing impending Local Self Government Institution elections and the risk of administrative paralysis.
  • The Election Commission of India opposed any pause, saying more than half of the revision is complete and the overlap would last only four to five days.
  • Key timelines now overlap: SIR enumeration is due by December 4 with submissions on December 9 and final rolls on February 7, while LSGI voting is on December 9 and 11 with counting on December 13 and completion by December 18.
  • The State argued that BLOs, EROs and AEROs are the same limited pool needed for both exercises, even though the SIR order exempts officers already engaged by the State Election Commission.
