Kerala Court Sentences CPI(M) Candidate, Aide to 20 Years for 2012 Payyanur Bomb Attack

The ruling puts the party’s Payyanur campaign at risk because its nominee now faces potential disqualification.

Overview

  • On November 25, the Taliparamba Additional District and Sessions Court sentenced V. K. Nishad and T. C. V. Nandakumar, ruling their concurrent terms translate to 10 years in custody.
  • The court imposed fines of ₹2.5 lakh each and convicted them under IPC section 307 and sections 4 and 5 of the Explosive Substances Act, with an additional year possible if fines are not paid.
  • Nishad is a DYFI leader and the LDF’s candidate for a Payyanur municipal ward, and the CPI(M) has kept party worker M. Harindran on the ballot as a contingency.
  • The case stems from an August 1, 2012 attack in Payyanur when crude bombs were thrown at a police vehicle during protests after the arrest of CPI(M) leader P. Jayarajan; the bombs did not explode and no injuries were reported.
  • Two co-accused, A. Mithun and K. V. Kripesh, were acquitted by the court.
