Kentucky Bans Drones for Hunting and Fishing Under New State Regulation

A broad definition of 'take' gives wardens a clear enforcement framework with narrow exceptions.

Overview

  • The Kentucky Department of Fish and Wildlife says administrative regulation 301 KAR 3:140 is now in effect following the Oct. 16 committee adjournment.
  • The rule makes it unlawful to use aircraft or unmanned aircraft to take fish or wildlife, to drive or herd animals for that purpose, or to harass wildlife.
  • Limited allowances include agency operations for safety, research, management or law enforcement; authorized landowner damage control; and commercial efforts to locate or remove invasive carp.
  • Officials note that statewide rules apply on public and private lands, and scouting that does not assist a take or using a drone to help recover a carcass is permitted.
  • Maj. David Marques said the measure fills a long-standing gap by clarifying drone use and providing investigators a framework for potential violations.
