Overview
- A Wyandotte County judge released a KBI affidavit describing video that shows Deputy Richard Fatherley placing his knee and weight on Adair’s lower back for about 1 minute and 30 seconds as Adair yelled, “Help.”
- Court documents say Adair was handcuffed in front and placed prone on a lower bunk while other deputies held his limbs, with his last visible movement at approximately 8:36:46 p.m. and Fatherley disengaging at 8:37:48 p.m.
- A nurse check found Adair unresponsive shortly after the restraint, and he was pronounced dead at 9:19 p.m.
- An autopsy determined the cause of death was complications of mechanical asphyxia and ruled the manner a homicide, noting contributing chronic health conditions.
- District Attorney Mark Dupree has charged Fatherley with second-degree murder or, in the alternative, involuntary manslaughter, issuing a summons for Nov. 18 as Adair’s family and attorneys press for release of the body-camera video.
