Karnataka HC Seeks Centre’s Reply on Challenge to Online Gaming Ban, Sets Sept. 8 Hearing

The court is being asked to weigh Parliament’s power to regulate online gaming alongside the timing of a notification.

Overview

  • Justice B. M. Shyam Prasad directed the Union government to file its objections by September 8 and adjourned further hearing to that date.
  • The Promotion and Regulation of Online Gaming Act has Presidential assent but was not notified at the time of the hearing.
  • Solicitor General Tushar Mehta told the court notification is a constitutional function that may proceed soon and is not subject to advance notice.
  • Petitioner Head Digital Works (A23) said it would not press for an interim stay on skill games if the Centre refrains from notifying the Act during the case.
  • The law bans all online real‑money gaming, including skill‑based titles, treats violations as cognisable and non‑bailable, and the petition cites risks to over two lakh jobs and tens of thousands of crores in investment.
