Karnataka HC Issues Notice to Government on SEC Plea for Municipal Reservation Finalisation

The SEC says pending final reservations are blocking preparations for local-body elections as terms near expiry.

Overview

  • A division bench of Chief Justice Vibhu Bakhru and Justice C. M. Poonacha ordered the state to file a counter-affidavit and listed the case for December 11.
  • The SEC’s petition seeks final ward reservations under Section 13(1)(d) and simultaneous reservations for Adyaksha and Upadhyaksha posts under Section 42(2-a) across 187 urban local bodies.
  • The High Court last week issued notice on a related SEC plea seeking final seat reservations for 5,950 Gram Panchayats under Section 5(5) of the 1993 Act, with both matters set for hearing on December 11.
  • Government counsel Niloufer Akbar told the court the vacancies arise in January 2026 and requested a week to obtain instructions from the state.
  • The SEC has told the court it cannot commence election processes without the government’s category-wise reservation notifications for ULB wards and leadership posts.
