Overview
- On Sept. 29, the Ministry of Justice presented a draft with multiple numeric options to the Law Revision Council subcommittee for clarifying elements of the dangerous-driving-causing-death offense.
- A speed option A would trigger the offense at over +50 km/h on roads with limits above 60 km/h or over +40 km/h where limits are 60 km/h or below, while option B raises those excesses to +60 km/h and +50 km/h.
- For alcohol impairment, the draft offers breath thresholds of 0.25 mg/L or 0.5 mg/L, referencing WHO gradations, with language allowing prosecution when impairment is shown even below those numbers.
- The draft proposes explicitly covering drift driving, defined as intentionally sliding or lifting tires to the point that controlling a vehicle’s movement becomes difficult.
- Committee members remain split between calls for stricter, clearer punishment and caution over broadening liability, and the government is aiming to submit revisions next year without a final threshold selected.
