Overview

  • U.S. District Judge Waverly D. Crenshaw Jr. held a July 16 hearing on the Justice Department’s appeal of Magistrate Judge Barbara Holmes’ decision to grant bail.
  • Prosecutors argued that no conditions could reasonably assure Abrego Garcia’s court appearances or protect the community and urged continued detention.
  • Defense attorneys warned that any release would immediately transfer him to ICE custody and result in deportation to Mexico or South Sudan, cutting off his access to criminal due process.
  • Abrego Garcia, who pleaded not guilty to federal human smuggling charges after his wrongful deportation to El Salvador in March, is accused of transporting migrants during a 2022 Tennessee traffic stop.
  • Judge Crenshaw took the appeal under advisement without issuing a ruling, prolonging uncertainty over whether Abrego Garcia will remain in U.S. custody pending trial.
