- U.S. District Judge Angel Kelley issued an administrative stay on Dec. 30 that prevents the South Sudan TPS designation from expiring in early January.
- Roughly 232 current beneficiaries and about 73 applicants retain work authorization and protection from deportation during the stay.
- DHS must file its opposition by Jan. 9, and the plaintiffs’ reply is due Jan. 13, after which the court will consider next steps.
- Homeland Security Secretary Kristi Noem moved to terminate TPS on Nov. 5, citing improved conditions, a contention plaintiffs and U.N. experts dispute given persistent violence and humanitarian crises in South Sudan.
- The case is part of broader challenges to TPS rollbacks, and on Dec. 31 a federal judge in California also blocked terminations for Honduran, Nepalese and Nicaraguan nationals.
