Judge Temporarily Blocks Trump Administration Move to End TPS for South Sudanese

The pause gives the court time to review a lawsuit alleging DHS unlawfully terminated protections.

  • Roughly 232 current beneficiaries and about 73 applicants retain work authorization and protection from deportation during the stay.
  • DHS must file its opposition by Jan. 9, and the plaintiffs’ reply is due Jan. 13, after which the court will consider next steps.
  • Homeland Security Secretary Kristi Noem moved to terminate TPS on Nov. 5, citing improved conditions, a contention plaintiffs and U.N. experts dispute given persistent violence and humanitarian crises in South Sudan.
  • The case is part of broader challenges to TPS rollbacks, and on Dec. 31 a federal judge in California also blocked terminations for Honduran, Nepalese and Nicaraguan nationals.
