Judge Rules West Point Can Continue Considering Race in Admissions

Students for Fair Admissions, who previously challenged race-conscious admissions at the Supreme Court, have filed an emergency notice of appeal.

  • U.S. District Judge Philip Halpern ruled that the U.S. Military Academy at West Point can continue to consider race in its admissions process, rejecting a request for a preliminary injunction by Students for Fair Admissions.
  • The group, which successfully challenged race-conscious college admissions policies at the Supreme Court, argued that West Point's use of race in admissions was unconstitutional.
  • The Supreme Court ruling in June 2023 did not apply to military academies, leaving them exempt from the ban on race-conscious admissions policies.
  • Judge Halpern stated that an injunction at this stage would disrupt the current admissions cycle that is set to end on January 31.
  • Students for Fair Admissions has filed an emergency notice of appeal following the judge's decision.
