Judge Remands SouthCoast Wind Permit, Allowing Trump Administration Reconsideration

The decision opens the door to a fresh federal review that could change or revoke the Biden-era approval.

Overview

  • U.S. District Judge Tanya S. Chutkan ruled the developers would not face immediate and significant hardship from reconsideration and ordered the permit sent back to BOEM.
  • The 2.4-gigawatt project with roughly 141 turbines is planned about 20–23 miles south of Nantucket and has not begun construction.
  • BOEM will reexamine the Construction and Operations Plan for legal compliance and may approve, disapprove, or approve with conditions.
  • Nantucket, which sued in March alleging deficiencies in environmental and historic-preservation review, praised the ruling.
  • SouthCoast Wind says it has invested over $600 million and is evaluating legal options as the administration ramps up reviews of offshore wind permits.
