Judge Orders Pensioner to Pay £113,266 in Three Months or Face Sale of Bungalow in 1ft Fence Dispute

The order caps years of failed challenges that inflated a £14,000 award into six figures.

Overview

  • District Judge Ross Fentem ruled at Bournemouth County Court that 76-year-old Jenny Field must settle £113,266 within three months or her Hamworthy, Poole bungalow will be sold.
  • The dispute began after Pauline Clark replaced a boundary fence in 2020, leading to a December 2022 judgment awarding Clark about £14,000 for damage and costs.
  • Field repeatedly tried to relitigate, prompting a civil restraint order after she sent the court "hundreds if not thousands" of pages, and her separate £500,000 counter-claim was dismissed as totally without merit.
  • The judge described an order for sale as a last-resort, adding £7,454 in further costs and stating he had no confidence the debt would be paid by other means.
  • Field did not attend the hearing and later said she will put her home on the market, while Clark’s side cited severe stress and counselling and noted the long delay in receiving payment.
