Judge Lets McRib Class Action Over Meat Claims Move Forward

The ruling opens discovery to test plaintiffs' claims about advertising, patty composition, consumer expectations.

Overview

  • U.S. District Judge April Perry on Friday rejected McDonald’s bid to throw out the lawsuit and allowed consumer-deception, fraud and unjust-enrichment claims to proceed in federal court.
  • The December 2025 complaint says McDonald’s shaped the McRib patty with ridges and used the name to create the impression of rib meat while charging premium prices.
  • Plaintiffs allege the patty is made from restructured lower-grade pork cuts such as shoulder, heart, tripe and stomach rather than actual rib meat.
  • McDonald’s disputes those claims, saying the McRib is made from 100% pork sourced from U.S. suppliers and that it does not use heart, tripe or scalded stomach in the patty.
  • The case will move into discovery where the parties will probe marketing materials, ingredient records and consumer-survey evidence and may face further motions before any finding of liability.
