Judge Hears Bid to Disqualify Prosecutors in Charlie Kirk Case

The defense says a prosecutor’s 18-year-old child at the event creates a conflict of interest.

Overview

  • District Judge Tony Graf allowed evidentiary testimony on the alleged conflict but declined to remove the Utah County Attorney’s Office or move the case at this stage.
  • Further witnesses on the conflict question are set to be heard on Feb. 3, while a preliminary hearing remains scheduled for May 18–21.
  • Utah County Attorney Jeff Gray testified and argued there is no conflict, saying the student did not witness the shooting and has no material information; he criticized the defense’s tactic as an ambush.
  • Defense lawyers contend the rapid decision to pursue the death penalty shows emotional bias and asked that the Utah Attorney General handle the disqualification issue; the judge kept the county office in place pending more evidence.
  • The court reinforced media limits to protect due process, restricting images of restraints and certain close-up filming, as Robinson, 22, faces aggravated murder and related charges supported by DNA, an alleged confession and text messages, and has not yet entered a plea.
