Judge Halts Texas Campus Speech Restrictions Across UT System

The preliminary injunction finds SB 2972 likely unconstitutional under the First Amendment.

Overview

  • U.S. District Judge David Alan Ezra issued a preliminary injunction blocking enforcement of the Campus Protection Act at all University of Texas System institutions and for the named plaintiffs.
  • The law would have banned all “expressive activities” from 10 p.m. to 8 a.m. and restricted guest speakers, amplified sound, and percussive instruments during the last two weeks of each academic term.
  • Ezra wrote that the state failed to prove the rules were narrowly tailored to a compelling interest, calling them overbroad and warning they could be weaponized against disfavored speech.
  • The Foundation for Individual Rights and Expression sued on behalf of UT Austin and UT Dallas students and groups, including a campus ministry, a student newspaper, Young Americans for Liberty, and performance organizations.
  • The order is temporary while litigation continues, with plaintiffs seeking permanent relief and the UT System stating it will comply with the law and court orders.
