Overview

  • U.S. District Judge Paula Xinis prolonged a temporary order preventing Kilmar Abrego Garcia’s removal and scheduled an Oct. 6 evidentiary hearing.
  • The judge said she expects to rule within 30 days of the hearing and ordered that he remain in ICE custody within 200 miles of her Maryland courtroom.
  • Xinis indicated she intends to hear testimony from Trump administration officials about efforts to re-deport him.
  • Abrego Garcia has moved to reopen his immigration case to seek asylum, has filed a fear claim contesting removal to Uganda, and has indicated a preference for Costa Rica if removal occurs.
  • He was wrongly deported to El Salvador in March despite a 2019 order barring removal there, was returned in June, and now faces federal migrant-transport charges to which he has pleaded not guilty.
