Judge Dismisses Palmer Lake Annexation Lawsuit as Trustee Resigns

Voters will decide whether to annex 25 acres for a proposed Buc-ee’s in an early-2026 special election required under the town’s new voter-approval rule.

Overview

  • A district court on Oct. 3 granted the Town of Palmer Lake’s motion to dismiss the lawsuit filed by Integrity Matters over the annexation process.
  • Trustee and mayor pro tem Amy Hutson resigned effective Oct. 3, citing contentious meetings and litigation, and wrote that she would have voted no on Buc-ee’s.
  • The Board of Trustees voted 4–3 on Oct. 2 to send the annexation question to a special election, with ballot language still to be finalized and the vote expected early next year.
  • Earlier this fall, residents approved a measure requiring voter approval for all annexations, shifting the final decision from trustees to the electorate.
  • Integrity Matters said it will continue opposing the annexation, announcing plans to seek reconsideration and potentially appeal, and noted a special meeting ended before public comment the night prior.
