Overview
- U.S. District Judge Timothy J. Kelly granted the Justice Department's unopposed motion to dismiss with prejudice the prosecutions of Ethan Nordean, Joseph Biggs, Zachary Rehl and Dominic Pezzola, implementing a D.C. Circuit panel's earlier vacatur.
- Kelly said the dismissal was mandated by President Trump's Executive Order instructing the Attorney General to pursue dismissals of Jan. 6-related indictments, and he found he had no legal authority to refuse the government’s request.
- The judge strongly criticized the substance of overturning the convictions and singled out Pezzola for breaking a Capitol window that created an entry point for rioters, while stressing the court did not agree with the Executive's view of Jan. 6.
- Three of the men were convicted of seditious conspiracy in 2023 and Pezzola was convicted on assault, obstruction and property-destruction counts, but those convictions were vacated in May by the appeals panel before the district court's July ruling.
