Overview

  • On June 4, Judge James Boasberg ruled that all noncitizens deported on March 15 and 16 under the Alien Enemies Act must be allowed to challenge their removals.
  • He found that the administration deprived the detainees of their constitutional right to habeas relief before their summary deportations.
  • The court set a June 11 deadline for the government to outline a process enabling legal challenges from inside El Salvador’s CECOT prison.
  • Many deportees are Venezuelans accused of Tren de Aragua ties despite evidence suggesting flimsy or erroneous allegations.
  • El Salvador’s President Nayib Bukele has refused to repatriate mistakenly deported individuals, complicating efforts to implement the ruling.
