JNJ Suspends Peru’s Chief Prosecutor Delia Espinoza for Six Months

The oversight body says she ignored an order to reinstate Patricia Benavides.

Overview

  • The suspension is provisional and stems from a disciplinary finding that Espinoza failed to execute Resolution 231-2025-JNJ ordering Benavides’ return to the Fiscalía de la Nación and to her supreme post.
  • Espinoza skipped the scheduled public hearing and instead led a press conference where she denounced the process as illegal and politically motivated.
  • The JNJ held a brief session noting her absence and then issued the six-month suspension following the pending vote on the ponencia by María Teresa Cabrera.
  • Magistrate Francisco Távara was removed from the case for an alleged advance expression of opinion, with the JNJ citing impartiality rules.
  • Espinoza’s lawyer said they had not been formally notified of the decision and announced plans to pursue constitutional remedies, while an ex–security manager disputed media claims that Espinoza ordered Benavides blocked from entering the building on June 16.
