JNE Voids López Aliaga’s Senatorial Credential

The electoral tribunal said López Aliaga’s written refusal left his mandate unconfigured, prompting the call of the next candidate and the drafting of a law to avoid similar gaps.

Overview

  • The JNE ruled on Sunday, July 19, 2026, to leave without effect the senatorial credential issued to Rafael López Aliaga and to summon Absalón Vásquez to assume the seat for 2026–2031.
  • The tribunal acted after the Congress notified it that López Aliaga had sent a written statement saying he would not be sworn in or assume the office before the new Parliament was installed.
  • In Resolution No. 1757-2026-JNE the court said the proclamation of results does not by itself start a legislative mandate and that the mandate only configures once the formal incorporation or juramentación occurs.
  • The decision was adopted by majority with a dissenting vote from magistrate Gunther Gonzales Barrón and does not alter the election results or the original proclamation of candidates.
  • The JNE instructed its legal office to draft a bill to regulate cases where an elected lawmaker refuses incorporation, a step that could change how party lists and congressional seats are filled and affect Renovación Popular’s representation.
