Italy Imposes Strict Penalties for Vehicle Littering Under New Decree-Law

Overview

  • The temporary decreto-legge n. 116, effective August 9, allows post-facto use of municipal, motorway and private camera images queried against Motorizzazione data to identify vehicle owners without on-the-spot stops.
  • Smaller litter such as cigarette butts or tissues carries administrative fines up to €1,188, while dumping cans, bottles or waste bags triggers prosecutor referral and penalties ranging from €1,500 to €18,000.
  • Disposing of non-hazardous waste near rivers or in protected areas may lead to arrest within 48 hours and prison terms of six months to five and a half years.
  • The decree enables licence suspension for up to six months and allows confiscation of private and company vehicles, with employers facing criminal liability for employees’ illegal dumping.
  • Unless converted into law by October 7, the decree will expire, creating pressure on Parliament to secure the measures permanently.
