Interior Seeks to Vacate Approval of US Wind’s 2 GW MarWin Project Off Maryland

Regulators now say their earlier review did not fully account for risks to maritime safety.

  • The Department of the Interior filed a Sept. 12 motion in Maryland federal court to remand or vacate BOEM’s December 2024 approval of US Wind’s Construction and Operations Plan for the MarWin project.
  • BOEM told the court its prior analysis underestimated impacts to search-and-rescue operations within the lease area and to commercial fisheries, and it asked to reconsider the decision even if approval is not vacated.
  • The filing comes in a case brought by Ocean City and other plaintiffs challenging the approval; the government said vacatur would render that suit moot.
  • The administration has signaled similar remand-with-vacatur motions for SouthCoast Wind by Sept. 18 and New England Wind by Oct. 10, following earlier actions including a stop-work order for Revolution Wind and the rescission of $679 million in port grants.
  • US Wind said it will vigorously defend the permits in court and remains committed to building its Maryland project, describing it as a 1,700MW development located about 10.7 miles off Ocean City, Maryland and Fenwick Island, Delaware.
