Instacart Adds $5.99 'Regulatory Response' Fee to NYC Orders After New Worker Rules Take Effect

The city’s consumer protection agency has opened an inquiry into the surcharge.

Overview

  • Instacart confirmed the fee began this week on New York City orders and said it reflects higher costs from what it called the City Council’s “misguided and burdensome” regulations.
  • The rules now require grocery delivery platforms to pay workers at least $21.44 per hour before tips, add a pre-checkout tipping prompt with a 10% default, and raise the pay floor to $22.13 in April.
  • U.S. District Judge George B. Daniels declined to block the ordinance, and judges also rejected separate efforts by Uber Eats, DoorDash, and Instacart to halt the measures last week.
  • The Department of Consumer and Worker Protection said it is reviewing Instacart’s new fee, which appears in the order summary at checkout.
  • DoorDash lists a $1.99 “NYC Regulatory Response Fee,” Uber has a similar charge, and some customers criticized the added costs on social media and discussed canceling memberships.
