INSS Opens Administrative Refunds for Heirs and Pensioners of Deceased Fraud Victims

The move gives families a path to recover unauthorized deductions exposed by Operação Sem Desconto without going to court.

Overview

  • Starting Wednesday, November 19, pension holders and legally recognized heirs can request refunds for deductions taken between March 2020 and March 2025 via Meu INSS, phone 135, PrevBarco or Correios.
  • About 800,000 deceased beneficiaries were affected, with nearly R$700 million deducted before death, and recovered amounts will be split among eligible pensioners or successors.
  • Heirs of those who did not leave a survivor pension must first be recognized in the INSS system by submitting an escritura pública or judicial order, plus ID and proof of address.
  • To date, roughly 3.7 million beneficiaries have received R$2.5 billion in refunds after more than 6.1 million contests, while over 1 million who contested still need to complete the adhesion step to be paid.
  • The government extended the contestation deadline to February 14, 2026, associations have 15 business days to respond to each contest, and the Federal Police estimate total losses could reach R$6.3 billion.
