INSS Creates 10-Day Reanalysis for Auxílio‑doença Denials

The new rule lets workers supply corrected medical documents for review by a different federal medical examiner and aims to speed decisions and cut unnecessary appeals.

Overview

  • A joint Portaria published on Friday, November 6, 2026, lets claimants whose auxílio por incapacidade temporária was denied for insufficient medical documentation request a reanalysis within 10 days of the decision.
  • The reanalysis must be done by a different Perícia Médica Federal examiner and gives claimants the chance to submit new or corrected atestados, exam results, and reports before filing an administrative appeal.
  • If the second examiner upholds the denial, the worker then has 30 days to appeal to the Conselho de Recursos da Previdência Social; alternatively claimants may forfeit reanalysis by filing an immediate appeal within the same 30‑day window.
  • After two consecutive documentary denials through the Atestmed system, subsequent requests will be routed automatically for medical‑perícia scheduling, which may be in person or by telemedicine.
  • The change was adopted administratively after TCU scrutiny and aims to reduce needless appeals and speed accurate decisions, but success will depend on INSS capacity to meet the one‑week to ten‑day reanalysis expectation and on claimants providing complete, legible medical records.
