India to File Lawsuits Against E-commerce Giants for Uncertified Goods

The Bureau of Indian Standards will file cases under Section 17 of the BIS Act after warehouse raids uncovered thousands of uncertified consumer products.

Overview

  • Amazon, Flipkart, Meesho, BigBasket and Myntra are set to face legal action for offering products without mandatory BIS certification
  • March raids in Gurugram, Chennai, Delhi, Faridabad and Lucknow led to the seizure of about 15,000 uncertified items valued at over Rs 1 crore
  • Violators risk fines up to ten times the value of non-compliant goods and up to two years’ imprisonment under the BIS Act 2016
  • Inspections revealed toys, shoes, baby diapers, kitchen appliances and electrical equipment bearing fake or missing ISI marks
  • Techvision International has already been taken to court for similar breaches and now enforcement is extending to major online marketplaces
