India Proposes IT Rules to Label and Trace AI-Generated Content

The ministry has invited feedback until Nov. 6 to craft measures responding to a surge in deepfakes.

Overview

  • The draft adds a definition of “synthetically generated information” to bring AI media under the IT Rules’ due diligence and takedown obligations.
  • Platforms that enable creation or modification must apply visible or audible labels and embed permanent metadata, meeting a 10% display or initial 10% audio standard.
  • Significant social media intermediaries (50 lakh+ users) must seek user declarations on AI use and deploy reasonable, proportionate technical checks to verify and mark such posts.
  • Labels and identifiers may not be altered, suppressed or removed, and traceability is reinforced with first-originator identification on court or Section 69A orders.
  • MeitY says non-compliance could affect safe-harbour while good-faith actions remain protected, and it is accepting public comments through Nov. 6.
