Overview
- New rules published in the Diario Oficial de la Federación took effect Thursday, Oct. 22, 2026 and change how former contributors join the IMSS Continuación Voluntaria program known as Modalidad 40.
- People already enrolled and paying before Oct. 22 will keep the salary base and contract conditions they signed until their current period ends.
- From now on new applicants can set a contribution salary no higher than their last registered salary plus one Unidad de Medida y Actualización (UMA), removing the prior option to choose up to 25 UMA.
- New entrants cannot make retroactive payments to cover prior lapses and must register exclusively through IMSS digital channels, and people registered as independent workers under fracción I of article 13 cannot hold Modalidad 40 at the same time.
- The IMSS ordered a finance study with up to six months to quantify fiscal effects and warned the limits could reduce late‑career strategies to raise pensions, an outcome that would most affect workers under the 1973 law and could change costs for hundreds of thousands of pensions.
