Overview
- The IMSS Council issued a temporary agreement that was published in the Diario Oficial de la Federación on Wednesday, Oct. 21, 2026, and takes effect on Oct. 22, 2026.
- People already enrolled in Modalidad 40 at the entry into force will keep their current contracted conditions and will retain recognition of weeks and salaries paid for future pension calculations.
- New registrations will be limited to the last registered salary base or up to one UMA above it while never falling below the national general minimum wage, and insurance coverage will begin only from the date a person files their request.
- The IMSS ordered that all new inscriptions be processed only through digital systems that guarantee traceability and consistency and required a special attention channel for exceptional cases; it also bars simultaneous Continuación Voluntaria for those in the independent-worker modality under article 13, fraction I.
- The Dirección de Finanzas, through the Unidad de Riesgos Financieros y Actuariales, must complete a financial and actuarial analysis within six months and the Dirección Jurídica then has up to six months to draft legal proposals, a process that could lead to lasting limits aimed at reducing very large future pension liabilities.
