IMSS Clarifies Eligibility and Minimums for Mexico’s Dual Pension Regimes

The July guidelines spell out age, contribution thresholds, minimum payouts under both IMSS pension laws.

Overview

  • Under Ley 73, workers who began contributions before July 1, 1997 can retire at 60 with 75% of their full pension or wait until 65 for 100%
  • To qualify for Ley 73, retirees must have at least 500 weeks of contributions, formally deregister from the mandatory regime and not be working when applying
  • Ley 73 pensions are calculated using the average salary of the last 250 weeks of contributions
  • Ley 97 pensions depend on the balance in an individual’s Afore account with an 850-week requirement in 2025 that increases by 25 weeks annually to reach 1,000 by 2031
  • IMSS guarantees a minimum pension of 9,412 pesos in 2025, ensuring payouts cannot fall below the statutory minimum
